By downloading, installing, or using BearGist (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

BearGist is a macOS menubar application that allows you to create, browse, and manage GitHub Gists. The App acts as a client interface to GitHub's API services.

3. Requirements

To use BearGist, you must:

  • Have a valid GitHub account
  • Generate a GitHub Personal Access Token with gist permissions
  • Use a Mac running macOS 12.0 or later
  • Agree to GitHub's terms of service

4. User Responsibilities

You are responsible for:

  • Maintaining the security of your GitHub account and access tokens
  • All content you create, upload, or share through the App
  • Ensuring your use complies with GitHub's terms of service
  • Any activity that occurs under your account

5. Prohibited Uses

You agree not to use the App to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Distribute malware or malicious code
  • Attempt to gain unauthorized access to any systems
  • Interfere with the proper functioning of the App

6. Intellectual Property

The App, including its design, code, and documentation, is owned by BearGist and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the App for personal or business purposes.

7. Third-Party Services

The App integrates with GitHub's services. Your use of GitHub through BearGist is also subject to GitHub's terms of service and privacy policy. We are not responsible for GitHub's services or any changes they may make.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE. USE THE APP AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEARGIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

11. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to terminate or suspend access to the App for violations of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
